Terms of Service
These Terms of Service ("Terms") govern your access to and use of AdsEmber. By creating an account or using the service, you agree to these Terms.
1. Acceptance of these Terms
AdsEmber is operated by Yulia Kulakova (Individual Entrepreneur), registered in Georgia ("AdsEmber", "we", "us", "our"). By creating an account, subscribing, or otherwise using the service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Refund Policy. If you do not agree, do not use AdsEmber.
2. Description of the service
AdsEmber is a subscription tool that monitors advertisers on the public Meta Ad Library and the public TikTok Ad Library and delivers digests — summaries of new creatives, long-running ads, and ads that have stopped — by email and, optionally, Telegram. Delivery frequency (weekly, daily, or on-demand) and the number of competitors you can track depend on your plan.
AdsEmber reads only data that is already publicly available in the official Ad Libraries. We are not affiliated with, endorsed by, or sponsored by Meta, TikTok, or any advertiser you choose to monitor.
3. Accounts
- You must be at least 18 years old and able to form a binding contract to use AdsEmber.
- You are responsible for the accuracy of the information you provide and for all activity under your account.
- You are responsible for keeping your login credentials confidential. Notify us promptly at support@adsember.com if you suspect unauthorised access.
- One account is for one customer; do not share credentials or resell access (see Acceptable use).
4. Acceptable use
You agree to use AdsEmber only for lawful competitive research based on public Ad Library data. You must not:
- Use the service to collect, infer, or process private personal data, or any data that is not already public in the official Ad Libraries.
- Resell, sublicense, white-label (except where your plan expressly permits), or otherwise redistribute the service or its output as your own product.
- Scrape, crawl, or bulk-extract AdsEmber itself, or attempt to circumvent plan limits, rate limits, or usage counters.
- Use the service to harass, defame, or unlawfully target any person or business, or in any way that breaches applicable law or the terms of Meta or TikTok.
- Interfere with, disrupt, probe, or attempt to gain unauthorised access to the service, its infrastructure, or other users' accounts.
- Use the service to send spam or to build unlawful marketing lists.
We may suspend or terminate accounts that breach this section.
5. Plans & billing (via Paddle)
- Paid plans are billed in advance on a recurring basis (monthly or annually) at the price shown at checkout, until cancelled.
- Your purchase is also subject to Paddle's Buyer Terms and Paddle's checkout terms, which apply in addition to these Terms. Billing questions, invoices, and payment-method changes are handled through Paddle.
- Prices may change; we will give reasonable notice, and any change applies from your next billing period.
- Applicable taxes (such as VAT/sales tax) are determined and collected by Paddle based on your location.
6. Free trials
If we offer a free trial, we will describe its length and terms at sign-up. Unless you cancel before the trial ends, your subscription may convert to a paid plan and be billed through Paddle at the then-current price. Only one trial per customer unless stated otherwise.
7. Cancellation
You may cancel your subscription at any time from your account settings or via the Paddle receipt/management link. Cancellation stops future renewals; you keep access until the end of the paid period already billed. Refunds are governed by our Refund Policy and are handled through Paddle.
8. Availability and "as is" disclaimer
We work to keep AdsEmber available and accurate, but the service depends on third-party sources (the public Meta and TikTok Ad Libraries) that we do not control and that may change, rate-limit, or become unavailable. To the maximum extent permitted by law, AdsEmber is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, completeness, or uninterrupted availability. Digests are informational and are not financial, legal, or professional advice.
9. Limitation of liability
To the maximum extent permitted by applicable law, AdsEmber and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or in connection with your use of (or inability to use) the service. Our total aggregate liability for any claim relating to the service is limited to the amount you paid for the service in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, and mandatory consumer-protection rights (including for EU/UK consumers) are not affected.
10. Intellectual property
AdsEmber, its software, branding, and the design and compilation of its digests are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription for your own business use. Advertiser names and public ad creative shown in digests remain the property of their respective owners and are displayed as sourced from the official public Ad Libraries.
11. Termination
You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if providing the service to you becomes impractical. On termination, your right to use the service ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
12. Governing law
These Terms are governed by the laws of Georgia, without regard to conflict-of-laws rules, and the courts of Georgia will have jurisdiction — except where mandatory consumer-protection law in your country of residence (for example, for EU or UK consumers) grants you the protection of your local law and courts, which is not affected by this clause.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, notify you by email or in-app. Your continued use of AdsEmber after an update means you accept the revised Terms.
